IN EXERCISE of the powers conferred by section 49 (1) of the Labour Relations Act (No. 14 of 2007), the Minister for Labour oders Messrs. Athi Stors Limited to:

DEDUCTION OF UNION DUES
IN EXERCISE of the powers conferred by section 48 (2) of the Labour Relations Act (No. 14 of 2007), the Minister for Labour makes the following Order:
(a) Revokes the earlier Order published under Gazette Notice No. 835 of 1997.
(b) Orders every employer who employs not less than five (5) members of Transport Workers Union of Kenya —
(i) to deduct every month the sums specified in the schedule in respect of trade union dues from the wages of his employees who are members of that union;
(ii) to pay within ten (10) days of the date of deductions, the total sums of deducted under item 1 of the schedule by crossed cheque made payable to the Transport Workers Union into that Union’s account No. 2830238 at Barclays Bank of Kenya Limited, Mama Ngina Street, P.O. Box 30011, Nairobi;

Box 48400, Nairobi.
(iv) to notify that trade union and the organization in writing within one (1) months of making the payment.
(v) make written returns to the Registrar of Trade Unions within one (1) months of making all the payments to the trade union and to that organization.

ENVIRONMENT AND LAND COURT (30 POSTS)
Ref.—V/No.2/2012.
Terms of Service.—Constitutional Office.
Period of Service.—Retirement at the age of 70 years with an election to retire on attaining the age of 65 years.
Functions.—A Judge of the Environment and Land Court shall serve in any Environment and Land Court station in Kenya and shall exercise the following functions:
(a) Have original and appellate jurisdiction to hear and determine all disputes relating to environment and the use and occupation of, and title to, land;
(b) Hear and determine disputes relating to:
• environmental planning and protection, trade, climate issues, land use planning, title, tenure, boundaries, rates, rents, valuations, mining, minerals and other natural resources;
• compulsory acquisition of land;
• land administration and management;
• public, private and community land and contracts, choses in action or other instruments granting any enforceable interest in land; and
• any other dispute relating to environment and land.
(c) Hear and determine applications for redress of a denial, violation or infringement of, or threat to, rights or fundamental freedom relating to the environment and Land under Chapter Five of the Constitution.
(d) Exercise appellate jurisdiction over the decisions of local tribunals in respect of matters falling within the jurisdiction of the court.
(e) Have supervisory jurisdiction over local tribunals, persons or authorities.
Constitutional and statutory requirements for appointment.
For appointment to the position of Judge of the Environment and Land Court, applicants must possess the following qualifications:
(a) Hold a law degree from a recognized university, or be an advocate of the High Court of Kenya, or possess an equivalent qualification in a common-law jurisdiction.
(b) Have at least ten (10) years’ experience as a Superior Court Judge or professionally qualified Magistrate; or
(c) Have at least ten (10) years’ experience as a distinguished academic or legal practitioner or such experience in other relevant legal field; or
(d) Have held the qualifications specified in paragraphs (b) and (c) for a period amounting, in aggregate, to ten (10) years.
NOTES
(i) The experience may have been gained in Kenya or in any other country with a Common Law jurisdiction;
(ii) Knowledge and experience in environmental and land matters will be an added advantage;
(e) Meet the requirements of Chapter Six of the Constitution and be of high moral character, integrity and impartiality. In addition, the applicants must demonstrate a high degree of professional competence, communication skills, fairness, good temperament, good judgment in both legal and life experiences and commitment to public and community service.
The appointments shall be made in accordance with Article 166 (1) (b) as read with Article 162 (2) (b) and (3) of the Constitution of Kenya, 2010.

(c) Have jurisdiction to hear appeals from decisions of tribunals of competent jurisdiction in disputes relating to employment and labour relations;
(d) Have jurisdiction to hear and determine any question respecting the interpretation of the Constitution in employment and labour relations including the determination of —
(i) The question whether any law is inconsistent with, or is in contravention of the Constitution;
(ii) The question whether anything said to be done under the authority of the Constitution or of any other law is inconsistent with, or is in contravention of the Constitution;
(iii)Any matter relating to constitutional powers of State organs in respect of county Government and any matter relating to the constitutional relationship between the levels of Government; and
(iv) A question relating to conflict of laws under Article 191 of the Constitution.
(v) Any other jurisdiction, original or appellate, conferred by any legislation in employment and labour relations.

INTENDED DESTRUCTION OF COURT RECORDS
IN ACCORDANCE with the Records Disposal (Courts) Rules, notice is given that three (3) months after the date of publication of this notice, the Principal Magistrate’s Court at Kitui intends to apply to the Chief Justice, for leave to destroy the records, books and papers of the Principal Magistrate’s Court at Kitui as set out below:
Criminal cases 1995–2007
A comprehensive list of all condemned records that qualify to be disposed under the Act can be obtained and perused at the Principal Magistrate’s Court Registry, Kitui.
Any person desiring the return of any exhibit in any of the above cases must make his/her claim within the time stipulated in this publication should do so before the expiry of the notice. All exhibits to which no claim is substantiated before the destruction of the records shall, under section 4, be deemed to be part of the records for the purposes of destruction.

INVITATION OF PUBLIC COMMENTS
PURSUANT to regulation 21 of Environmental (Impact Assessment and Audit) Regulations, the National Environmental Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the implementation of the proposed Mrima Hill Niobium and Associated Rare Earths Mining
Project.
The proposed project entails establishment of a Niobium Concentrate Plant on a suitable site within 20km of Mrima Hill. The main components of the proposed project will include on-site mining, access roads, related infrastructures, off-site concentration plant, construction workers compound, and waste tailings dam.
Mrima Hill is situated at around latitude 4°29’S, longitude 39°15’E in Msambweni Constituency of Kwale District on the coastal plain of Kenya, approximately 65km southwest of Mombasa.
The anticipated impacts and proposed mitigation measures are set out in the gazette.

Associated Isiolo substation.
The project will involve construction of transmission lines which comprise of towers on which conductors are mounted.
The proposed project will traverse part of the larger Nanyuki – Meru and Isiolo. This includes Kisima- Isiolo- Ruiri Section which falls within the Buuri District of Meru County and is estimated to be 51.4 Kilometers.

PURSUANT to regulation 42 of Environmental (Impact Assessment and Audit) Regulations, the National Environmental Management Authority (NEMA) has received a strategic environment assessment report for the proposed Konza Technology City The project proposes to establish Konza Technology City at Malili Ranch in Machakos and Makueni Districts located 60km South-East of Nairobi off Mombasa Road. The proposed project will be undertaken in a 5000 acres piece of land. The government commissioned a
Strategic Environment and Social Assessment study main objectives to:
(a) Integrate environmental concerns into all activities associated with the proposed project for sustainability.
(b) Ensure that all the potential environmental impacts of proposed strategic actions are considered.
(c) Assess alternatives in order to identify the best practical environmental option and;
(d) Provide a means of early warning of cumulative effects and large scale impacts.
The anticipated impacts on natural environmental features that are likely to be affected during the implementation of the project are set out in the gazette.

MUNICIPAL COUNCIL OF VIHIGA
DRAFT VALUATION ROLL 2008
PURSUANT to provisions of section 9 (3) of the Valuation for Rating Act and rule 9 (1) (ii) of the Valuation for Rating (Public Land) Rules, notice is given that the Draft Valuation Roll for 2008 was laid before the council at its ordinary monthly meeting held on 7th March, 2012 and is now open for public inspection at the Treasurer’s Office at Municipal Hall of Vihiga, during the ordinary working hours 8.30 a.m. to 4.00 p.m. on Monday to Friday as required by section 9 (2) of this act.
In conformity with Valuation for Rating Act, section 10 (1) and Rule (1) of Valuation for Rating (Public Land) Rules, all persons or relevant authorities aggrieved either—
(a) by inclusion of any rateable property in, or by the omission of any rateabe property from the Draft Valuation Roll 2008;
(b) by any value ascribed in the Draft Valuation Roll to any rateable property or by any other statement made or omitted to be made in the said Roll with respect to any rateable property;
may on payment of a non-refundable fee of Kenya shillings five hundred (KSh. 500) per entry, lodge an objection with the undersigned at Municipal Hall, Vihiga at any time within twenty-eight (28) days from the date of this notice in respect of private land and six (6) months in case of public land, on prescribed forms provided for the purposes (copies of which may be obtained from the treasurer’s office on application) in respect of any entry in the aforesaid Draft Valuation Roll , 2008, Municipal Council of Vihiga.
Parties aggrieved are requested particularly to note that no person shall be entitled to urge any objection before the Valuation Court unless they shall have first lodged such notice as aforesaid.

THE MUNICIPAL COUNCIL OF VIHIGA
RATES FOR 2008
NOTICE is given that pursuant to the provision of section 15 (1) of the Rating Act, the Municipal Council of Vihiga has fixed and levied the under-mentioned rates for the year 2008 and payable at the Municipal Council of Vihiga by 1st January, 2012.
Rates are a debt to the Municipal Council of Vihiga and whilst every effort shall be made to deliver a demand note to every rateable owner, failure to receive the same will not be held to absolve the debtor from any liability and penalty from any rates remaining unpaid after 30th June 2012.
The Unimproved Site Value Rates for 2008 are as follows:
Industrial/Commercial user at 1%
Residential user at 1%
The above rates become due on the 1st January, 2012 and under section 16(3) of the Rating Act, interest shall become payable at the rate of 3% per month or part thereof, on any rate remaining unpaid after 30th June 2012 and part of a month shall be reckoned as one (1) month.
